Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of the KAREON mobile application (the “App”), provided by KAREON (“KAREON”, “we”, “us”, or “our”). The App is a clinical practice-management tool intended solely for use by licensed doctors and their authorized staff (“Doctor”, “you”, or “User”).

By creating an account, logging in, or otherwise using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

1. Eligibility

1.1 The App is intended exclusively for use by qualified, licensed medical practitioners (and staff acting under a Doctor’s authorization). By registering, you represent and warrant that:

  • (a) you hold a valid medical license/registration in the jurisdiction where you practice;
  • (b) all professional credentials, registration numbers, and practice details you provide are accurate and current;
  • (c) you are at least 18 years of age and legally capable of entering into a binding agreement; and
  • (d) your use of the App to record, store, or manage patient information complies with all applicable medical ethics, licensing, and data-protection laws.

1.2 The App is not intended for direct use by patients. Patients do not register for or access accounts on the App. Any patient information present in the App is entered solely by the Doctor.

2. Account Registration and Security

2.1 You must register using accurate information and keep your login credentials confidential. You are responsible for all activity that occurs under your account.

2.2 You must notify us promptly at support@kareon.in if you suspect unauthorized access to your account.

2.3 We may suspend or terminate an account if we reasonably believe the registration information is false, the account is being used by someone other than a licensed medical professional, or these Terms have been violated.

3. Description of Service

The App allows a Doctor to, among other things:

  • Manage a professional profile and one or more practice locations
  • Manage appointment scheduling, availability, and rescheduling
  • Record and retrieve patient clinical entries, medical history, and reports
  • Receive push and in-app notifications relating to bookings and schedule changes

The App may operate with or without a live internet connection to Firebase; certain data is cached locally on-device to allow immediate access to your profile and key information.

4. Your Responsibilities as a Doctor / Data Controller

4.1 You are solely responsible for the accuracy, lawfulness, and appropriate use of all patient data you input into the App. As between you and KAREON, you are the data controller/fiduciary for your patients’ personal and health information, and KAREON acts only as a service provider processing that data on your instructions to operate the App.

4.2 You are responsible for:

  • (a) obtaining any consent required from your patients before recording their personal or health information in the App;
  • (b) ensuring your use of the App complies with applicable medical council regulations, record-keeping requirements, and data protection laws (including the Digital Personal Data Protection Act, 2023);
  • (c) the accuracy of clinical entries, prescriptions, and medical records you create; and
  • (d) maintaining the confidentiality of patient information consistent with your professional and ethical obligations, independent of any security features the App provides.

4.3 The App is a record-keeping and scheduling tool. It is not a substitute for your independent professional clinical judgment, and KAREON is not responsible for clinical decisions made using information stored in the App.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable medical, health-data, or data-protection law;
  • Enter data for or on behalf of any patient without an appropriate legal basis or consent;
  • Attempt to gain unauthorized access to another Doctor’s account or data, or to the App’s underlying systems;
  • Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
  • Use the App to transmit malware, spam, or harmful code;
  • Misrepresent your identity, medical qualifications, or licensing status.

6. Notifications

The App uses push notifications (via Firebase Cloud Messaging and, on iOS, Apple Push Notification service) to alert you about appointment activity based on your notification preferences. You may manage or disable these through the App’s settings or your device settings; disabling notifications may affect your ability to receive timely booking alerts.

7. Intellectual Property

7.1 The App, including its design, software, graphics, and branding, is the property of KAREON or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App.

7.2 You retain ownership of the patient data and professional content you input into the App. You grant KAREON a limited license to host, store, process, and transmit that data solely to the extent necessary to provide the App’s functionality to you.

8. Third-Party Services

The App relies on third-party infrastructure, including Google Firebase (Authentication, Firestore, Storage, Cloud Messaging) and, on iOS, Apple Push Notification service. Your use of the App is also subject to the availability and performance of these third-party services, which are outside our control.

9. Availability and Modifications

9.1 We aim to keep the App available and reliable but do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates, or factors outside our control (including third-party service outages).

9.2 We may modify, update, or discontinue features of the App at any time. Where reasonably possible, we will provide notice of material changes that affect core functionality.

10. Disclaimers

10.1 THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10.2 The App is a practice-management and record-keeping tool. It does not provide medical advice and is not a medical device. All clinical decisions remain the sole responsibility of the treating Doctor.

11. Limitation of Liability

To the maximum extent permitted by applicable law, KAREON and its officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or relating to your use of, or inability to use, the App, even if advised of the possibility of such damages. Our aggregate liability for any claim arising under these Terms shall not exceed the amount, if any, paid by you to us for use of the App in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from our gross negligence, willful misconduct, or fraud.

12. Indemnification

You agree to indemnify and hold harmless KAREON and its officers, employees, and service providers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any law or third-party right, including patient consent or data-protection obligations; or (c) content or data you input into the App.

13. Suspension and Termination

13.1 You may stop using the App and request account deletion at any time by contacting support@kareon.in.

13.2 We may suspend or terminate your access to the App if you breach these Terms, if required by law, or if we reasonably believe your continued use poses a risk to other Users, patients, or the integrity of the App.

13.3 Upon termination, your right to use the App ceases immediately. Data retention following termination is governed by our Privacy Policy and applicable medical record-retention laws.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably; failing which, they shall be subject to the exclusive jurisdiction of the competent courts of India.

15. Changes to These Terms

We may update these Terms from time to time. We will update the “Last Updated” date above and, for material changes, provide notice within the App. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
